Terms of Service

SwingShare provides a platform that facilitates discovery, booking, payment, and messaging between Hosts and Renters. Each rental is a direct agreement between the Host and the Renter. SwingShare is not a party to that agreement and is not responsible for the gear, its condition, its availability, or the conduct of any user.

SwingShare does not currently provide insurance, damage protection, security deposits, or dispute mediation. Hosts and Renters are solely responsible for arranging the handoff, inspecting gear, documenting its condition (we recommend photos at pickup and return), and resolving any issues directly with one another.

You must be at least 18 years old and able to form a binding contract to use the Platform. You agree to provide accurate information, keep your login credentials secure, and are responsible for all activity under your account.

As a user of the Platform, you agree that you will:

• Provide honest, accurate listings and booking information, including descriptions, photos, condition, and pricing.
• Communicate through SwingShare's in-app messaging and treat other users respectfully.
• As a Host, only list gear you own or are authorized to rent, and that you are comfortable renting out and arranging directly with Renters.
• As a Renter, use rented gear responsibly and return it on time and in the condition you received it, accounting for reasonable wear.
• Comply with all applicable laws and not use the Platform for any unlawful, fraudulent, or harmful purpose.

Renters pay the booking amount through our third-party payment processor, Stripe. SwingShare does not collect or store your full payment card details.

SwingShare charges a 15% platform fee, which is deducted from the Host's payout. The Host receives the remaining 85%of the booking total. Payouts to Hosts are processed by Stripe to a connected bank account, subject to Stripe's verification and payout schedules. Fees may change with notice posted on the Platform.

Because each rental is an agreement directly between the Host and Renter, cancellations and any refunds are arranged between those parties and processed back through Stripe where applicable. We encourage users to communicate early through in-app messaging if plans change.

The Platform is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, SwingShare disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. SwingShare does not warrant the quality, safety, legality, or availability of any gear listed by Hosts, or the conduct of any user.

To the fullest extent permitted by law, SwingShare and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, gear, or goodwill, arising out of or related to your use of the Platform or any rental arranged through it — including damage to, loss of, or failure to return gear.

Because SwingShare is not a party to rentals and does not provide insurance or damage coverage, any dispute over gear is between the Host and the Renter. To the extent SwingShare is found liable despite the above, its total liability is limited to the platform fees it received on the transaction giving rise to the claim.

You may stop using the Platform at any time. SwingShare may suspend or terminate your account, with or without notice, if you violate these Terms, create risk or legal exposure, or for any other reason at our discretion. Provisions that by their nature should survive termination (such as disclaimers and limitations of liability) will survive.

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any disputes will be subject to the exclusive jurisdiction of the state and federal courts located in Florida. (Governing law and venue are placeholders pending legal review.)

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
